These services include the submission of Green Card applications, online and offline consulting on immigration services, as well as assistance with filing immigration documents.

The brand "American GC," the Website, and the products offered, including any web-based software ("Software"), are owned and developed by American GC ("Company" or "us" or "we" or "our"). These Terms of Use constitute a legally binding agreement between you ("Customer" or "you" or "your") and the Company.

By visiting or using any of the American GC Websites or the offered products, you acknowledge that the American GC brand, Website, and offered products are owned by the Company, a private marketing corporation. It is important to note that American GC is not an official organ of the United States Government or in any way connected to the United States Government. American GC is not affiliated with the United States Government, immigration authorities, or a law firm. American GC does not provide legal advice or solutions for individual problems.

Please be aware that the United States Government has the authority to cancel or modify various immigration terms and programs, including the DV Program, at any time with government or legislative approval. In the event of such cancellation, suspension, prohibition, or prevention of the immigration terms, programs, or the offered products, the Company will not be held responsible and will not provide refunds for payments made prior to any such announcement. Additionally, you acknowledge that participation in the DV Program is based on a lottery, and the use of the offered products does not guarantee an increased chance of winning.

You acknowledge that the DV Program operates as a lottery, and consequently, winning is not guaranteed. All submitted applications, whether through this site or otherwise, have an equal opportunity in the lottery. Eligible entrants are randomly selected by a governmental computer, and American GC plays no role in the winner selection process. Opting for our services does not assure or enhance the likelihood of winning the lottery.

Furthermore, the Company is a privately-owned entity and is not affiliated with the United States Government or the USCIS. You are responsible for individually filling out the form. You can enter the U.S. Diversity Visa Lottery for free at: www.state.gov.

It is important to clarify that our engagement is non-exclusive, and either Party have the right to terminate this engagement at any time subject to the provisions of this Terms. . If you choose to terminate your engagement, all your obligations as detailed in the Terms and Conditions must be fulfilled.

By visiting American GC Websites or using any of the services and offered products, you declare that you have read, agreed to, and accepted all the terms and conditions outlined in the Terms of Use, including those expressly stated below and those incorporated by reference. It is your sole responsibility to read the Terms of Use, as well as any other relevant information and policies provided by the Company.

If any limitation imposed by applicable law prevents or restricts your ability to be bound by the Terms of Use or any part thereof, you may not visit or use American GC Websites or offered products. By accessing or utilizing American GC Websites or their provided products, you affirmatively declare your complete adherence to all relevant laws, including those that might impose restrictions based on age or other limitations, affecting your capacity to engage in agreements or access American GC Websites or their offered products.

Private Entity

Please note that American GC is a private entity and is not, and does not purport to be, an official organization of the U.S. Government or otherwise connected to the U.S. Government in any way. American GC is not the Immigration and Naturalization Service (INS) or the United States Citizenship and Immigration Service (USCIS), nor is it a law firm. American GC neither intends nor claims to provide legal advice or solutions to individuals' specific problems.

Please be aware that at any time, and upon the approval of the U.S. Congress, the U.S. Government has the authority to cancel the DV Program. American GC and this Site shall not be held responsible in case the U.S. Congress or the U.S. Government (or one of its Agencies) cancels, suspends, prohibits, or otherwise prevents (the "Prevention Announcement") the Lottery Visa Program or the Service, for reasons beyond American GC’s control, and will not provide a refund for payments made prior to any such Prevention Announcement.

Our Services

(1) The Offered Products include a variety of professional services and products, such as:

• simplifying the DV Program application process by assisting you in preparing your DV Program applications and photos in advance and according to the official U.S. Government regulations; submitting the DV Program applications to the U.S. State Department on your behalf during the brief registration period held once annually; Informing you promptly in the event of your win allows you to proceed with the necessary steps to secure a USA Green Card. It's essential to note that the U.S. Government does not directly contact winners, and as a result, our agents personally notify you if you have been selected;
• providing assistance and customer service throughout this crucial Green Card application phase, assisting in answering the application questions correctly, etc.;
• providing you with a professional personalized assessment of your visa and immigration options and eligibility (“Assessment“);
• reviewing your filling of the applicable forms (please be aware that the forms shall be filled by you and not AGC USA) or providing customer support to ensure the application is compliant with the E-DV Program.
• additional services that are directly related to your application and immigration process.

(2) It is hereby clarified that The Company is a marketing company only and is not a representative or connected in any matter to the United States government or immigration authority and is not involved in any way in issuing immigration visas.

(3) You hereby declare that you understand that using our services or choosing the Offered Products does not guarantee a better or expedited handling or increase the chance of winning.

Your Obligations

You are required to provide us with all the necessary information and materials (e.g., photos) in the form and quality requested by us before the deadline to participate in the official Green Card Lottery. During the ordering process, you will be informed of the current deadline for the submission of all data to us.

You are required to provide us with accurate data and promptly inform us of any changes. You are not authorized to apply multiple times with different names or addresses. We will not check the information given to us by you for content-related veracity.

You transfer to us all rights of use for submitted photos and assure us that the rights do not infringe on the rights of third parties (e.g., copyright laws). Should a third party assert a user infringement claim because of the unauthorized use of a photo, you are required to indemnify us from third-party claims in this respect. Your obligations under the indemnity clause require you to cover the full legal defense costs (e.g., court and lawyer expenses) for us.

We explicitly point out that customers who win and accept their win must submit additional forms to the United States authorities on time to apply for the Green Card. You are also obligated to support us by collecting and sending us all the necessary forms and paperwork orderly and on time for the process of the application.

If you violate these obligations, we reserve the right to withdraw from the contract and/or claim compensation because of a breach of contract.

Fees and Payments

(1) You are responsible for any applicable government fees, if applicable. Certain services provided by us require payment, either directly to us or to our third-party service providers.

(2) In accordance with applicable consumer law, you are entitled to a grace period of fourteen (14) days from the date of purchase of the Offered Product ("Grace Period"). However, if you utilize our services in any way, such as filling out an application, using our assessment services, or any other services, you agree to waive the right to cancel during the Grace Period and acknowledge that no refund will be provided.

(3) All fees and charges to the Company, if applicable, must be paid using a valid credit or charge card or other accepted payment methods as specified on the Website.

(4) The Company reserves the right to use third-party electronic payment processors or financial institutions to process payments made by you.

(5) By using our services, you acknowledge and agree that the Company has the right to conduct credit checks on all users through third-party credit agencies based on the information provided by you in your application or any other means.

(6) In the event of suspected fraudulent payments, including the use of stolen credit cards or any other fraudulent activity, the Company reserves the right to block a user's account and reverse any refunds issued, if applicable. The Company may also inform relevant authorities or entities, including credit reference agencies, about any payment fraud or unlawful activity. Additionally, the Company may employ collection services to recover payments.

(7) If you encounter any issues, including matters related to financial reimbursement, please contact our Customer Service Department at: support@americangc.com. If you unilaterally resolve the issue by canceling a transaction through your bank or credit card company, we reserve the right to contact the bank and submit a re-presentment letter to reclaim the funds. We may, at our discretion, discontinue providing the Offered Products or Software to specific users or users who use certain credit cards.

Fees & Refund/Cancellation Policy

Refunds will be given at the sole discretion of the American GC management. No refunds will be given after the applicant's green card lottery application has been submitted to the U.S. State Department, as the service the applicant paid for has been rendered completely at that time. Fees paid are not recoverable if the filing of the lottery registration is made impossible by any events beyond the control of American GC (for example, including but not limited to acts of war, acts of nature, changes in DV program instructions such as eligibility, required details, or other changes, technological limitations, submission of incorrect data, legislative or procedural change, and/or State Action). By submitting your application and payment to American GC, you understand and agree to the refund policy specified herein.

License and Access

(1) The Company grants you a limited, revocable, and non-exclusive license to access and use the Websites and Offered Products for personal use.

(2) You are prohibited from:

• Downloading or modifying the Websites or any portion of them, except for page caching purposes.
• Reselling or commercially using the Websites or Offered Products or their contents.
• Creating derivative works of the Websites or Offered Products or their contents.
• Using data mining, robots, or similar data gathering and extraction tools.
• Reproducing, duplicating, copying, selling, reselling, visiting, or exploiting the Websites or Offered Products or any portion of them for any commercial purpose.
• Framing the Websites or utilizing framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Websites or Offered Products without express written permission from the Company.
• Using the Company's logo or other proprietary graphics or trademarks (including American GC's name) without the express written permission of the Company.
• Intercepting, monitoring, damaging, or modifying any communication that is not intended for you.
• Using any type of spider, virus, worm, Trojan horse, time bomb, or any other codes or instructions designed to distort, delete, damage, or disassemble any part of the American GC Websites, Offered Products, or Software or the communication.
• Sending unsolicited commercial communications that are not permitted by applicable law.
• Exposing other users to offensive, harmful to minors, indecent, unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically, or otherwise objectionable material, including material that encourages criminal offenses, violates the rights of others, or otherwise violates any applicable laws.
• Using the Offered Products, Software, or Websites as a money transfer system for unlawful or fraudulent activities or prohibited transactions, including money laundering, under any law.

Support Provided

(1) We will provide you with reasonable support at our sole discretion, free of charge. The support will be available to you through various means, including phone support, subject to our discretion.

(2) You acknowledge that phone support may be provided through a call center that is not necessarily operated from the United States. Therefore, the phone calls may originate from U.S. phone numbers located outside the USA.

(3) Despite our commitment to providing support, it is important to note that we cannot guarantee a conclusive resolution of the matter for which our assistance was requested. Additionally, accessibility to our support services may vary in different cases. While we strive to deliver effective solutions, the outcome and availability of our support are contingent on the unique circumstances surrounding each situation. We encourage users to reach out to us with any concerns, but we acknowledge that individual results may vary, and our ability to address all cases is not guaranteed.

Privacy Policy

We value your privacy and are committed to protecting the information you share with us. Our Privacy Policy and Cookie Policy describes our practices, policies, and the type of information we collect.

Proprietary Information

Our employees are not authorized to make modifications to the Terms of Use or any additional representations, commitments, or warranties unless they are made in writing and signed by an authorized officer of the Company. (2) Additionally, the Company may add or remove features, change existing features, or provide programming fixes, updates, and upgrades to the American GC Websites, Offered Products, or Software at its sole discretion. You acknowledge and agree that the Company is not obligated to make previous or subsequent versions of the Websites, Offered Products, or Software available to you.

No Warranties

(1) The American GC Website, Offered Products, and Software are provided "as-is." The Company cannot guarantee uninterrupted communication or flawless delivery of your communication when using the Websites, Offered Products, or Software. The Company shall not be held liable for disruptions, delays, or other communication-related issues experienced while using the Software, Websites, and Offered Products.

(2) The Company is not responsible for any disturbances or malfunctions that the American GC Websites, Offered Products, or Software may cause to other software, applications, computer hardware systems, or data contained therein.

(3) The Company may suspend or terminate any of the American GC Websites, Software, or Offered Products, or parts thereof, for maintenance, updates, or other reasons, at its sole discretion and without prior notice. The Company shall not be liable or responsible for any consequences arising from such suspension or termination.

Disclaimer of Warranties

(1) The warranties stipulated in the Terms of Use, constitute the sole warranties of the Company and any of its owners, subsidiaries, divisions, affiliates, officers, directors, employees, agents, representatives, suppliers or licensors. Any warranties, expressed or implied, including without limitation, any warranty of merchantability or fitness for particular use or the legality of any of the American GC Websites or Offered Products or Software, not expressly granted by the Company are hereby disclaimed.

(2) ANY OF THE American GC WEBSITES OR OFFERED PRODUCTS OR SOFTWARE ARE PROVIDED ‘AS IS’, WITH NO WARRANTIES WHATSOEVER; THE COMPANY AND ANY OF ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS DO NOT, EITHER EXPRESSED, IMPLIED OR STATUTORY, MAKE ANY WARRANTIES, CLAIMS OR REPRESENTATIONS WITH RESPECT TO ANY OF THE American GC WEBSITES OR OFFERED PRODUCTS OR SOFTWARE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR USE OR A PARTICULAR PURPOSE. THE COMPANY AND ANY OF ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS FURTHER DO NOT REPRESENT OR WARRANT THAT THE American GC WEBSITES OR OFFERED PRODUCTS OR SOFTWARE WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE AND ERROR-FREE OR WILL OPERATE WITHOUT PACKET LOSS, NOR DO THE COMPANY AND ANY OF ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS WARRANT ANY SUCCESS OR ACCEPTANCE OF A VISA THROUGH ANY OF THE American GC WEBSITES OR OFFERED PRODUCTS OR SOFTWARE.

(3) The American GC Websites may allow you to access third party websites. Your access to and use of any third-party websites, including any goods, services or information made available from such websites, is governed by the terms and conditions found at each third party website, if any.

Liability Is Limited

(1) YOU ACKNOWLEDGE AND AGREE THAT THE COMPANY, ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS SHALL HAVE NO LIABILITY IN CONNECTION WITH OR ARISING FROM YOUR USE OR VISIT OF ANY OF THE American GC WEBSITES OR OFFERED PRODUCTS OR SOFTWARE.

(2) IN NO EVENT SHALL THE COMPANY, ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS BE LIABLE, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER FORM OF LIABILITY, FOR ANY INJURIES, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION ANY LOSS OF DATA, INTERRUPTION, COMPUTER FAILURE OR PECUNIARY LOSS) ARISING OUT OF THE VISIT OR USE OF ANY OF THE American GC WEBSITES OR OFFERED PRODUCTS OR SOFTWARE OR INABILITY TO USE SUCH, EVEN IF THE COMPANY, ITS OWNERS, SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(3) YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY DAMAGE, PROBLEMS OR DISSATISFACTION IN CONNECTION WITH ANY OF THE AGC USA WEBSITES OR OFFERED PRODUCTS OR SOFTWARE OR THE USE OR VISIT THEREOF IS TO CEASE USE OF SUCH WEBSITES OR OFFERED PRODUCTS OR SOFTWARE.

(4) If, notwithstanding the other provisions of this Agreement, The Company is found to be liable to you for any damages or loss which arises out of or is any way connected with the use of this Site or the Offered Products or Software, the Company’s liability shall in no event exceed the lesser of (a) the amount paid by you; or (b) $50.00 (U.S. Dollars). As some jurisdictions do not allow some of the exclusions or limitations as set forth above, some of these exclusions or limitations may not apply to you. In such an event the liability will be limited as far as legally possible under the applicable legislation. In any case, all warranties or guarantees given or made by the Company with respect to the Offered Product (a) are for the benefit of registered users of the Offered Product that comply with the terms of the Terms of Use only and are not transferable, and (b) shall be null and void if you breach any terms or conditions of the Terms of Use.

Indemnification

(1) You agree to indemnify, defend, and hold harmless the Company, its owners, subsidiaries, divisions, affiliates, officers, directors, employees, agents, representatives, suppliers, or licensors from any and all demands, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or in connection with your use of any of the American GC Websites, Offered Products, or Software.

(2) You agree to defend, hold harmless, and indemnify the Company from any and all liabilities, damages, actions, costs, expenses, including attorneys' fees, resulting from any third-party claims, including your own.

(3) Please note that in some jurisdictions, certain exclusions or limitations may not be allowed. In such cases, the liability will be limited to the extent permitted by applicable law.

Governing Law for Disputes

(1) You agree that any disputes arising from your access to or use of the Site, Offered Products, and/or Software, including all disputes, will be governed by the laws of the United Kingdom, without regard to its conflict of laws provisions. You consent to the personal jurisdiction and venue of the District Court in London, United Kingdom, and waive any objection to such jurisdiction or venue. Any claim under this Agreement must be filed within one (1) year after the cause of action arises, or the claim or cause of action is barred. In the event of a dispute between the Company and you arising from your use of the Site, Offered Products, and/or Software, the parties will attempt, in good faith and promptly, to resolve the dispute. If the parties are unable to resolve the dispute within a reasonable time (not exceeding thirty (30) days), either party may submit the dispute to mediation. If the dispute cannot be resolved through mediation, the parties are free to pursue any available rights or remedies under applicable law.

Headings

(1) The omission of action on our part in response to a violation of the Terms of Use, whether committed by you or others, should not be construed as a relinquishment of our right to address subsequent or similar violations of the Terms of Use. It is important to understand that our decision not to take immediate action in a specific instance does not, in any way, compromise our ability to enforce the terms in the future. We reserve the right to take appropriate measures, even if our intervention was not exercised in prior instances, and such actions will be undertaken in accordance with the terms and conditions outlined to preserve the effectiveness and consistency of our Terms of Use enforcement.

Violations

(1) Our failure to take action regarding a violation of the Terms of Use by you or others does not waive our right to take action regarding subsequent or similar violations of the Terms of Use.

Updates to Terms

We may make changes to these Terms from time to time, and if we do, we will notify you by revising the date at the top of the Terms. Unless otherwise noted, the amended Terms will be effective immediately, and your continued use of our Service will confirm your acceptance of the changes. Force Majeure

Neither party will be liable for delays in processing or other non-performance caused by such events as fires, telecommunications, utility, or power failures, equipment failures, labor strife, riots, war, non-performance of our vendors or suppliers, acts of God, pandemics, or other causes over which the respective party has no reasonable control; provided that the party has procedures reasonably suited to avoid the effects of such acts.

English Version

(1) The original English version of the Terms of Use may have been translated into other languages. In the event of any inconsistency or discrepancy between the English version and any other language version of the Terms of Use, the English language version shall prevail.

Acknowledgment and Consent

(1) You expressly acknowledge that you have read the Terms of Use and understand the rights, obligations, terms, and conditions stated herein.

(2) By using any of the American GC websites, offered products, or software, you expressly consent to be bound by the terms and conditions and grant the Company the rights described herein.
